Nestlé UK Ltd and Nestlé Ireland Conditions of Registration and Sale (for online orders)

1) PURCHASE CONTRACT

i) The UK Website and ROI Website is operated by Nestlé UK Ltd (the "Promoter", "we", "us" or "our") (registered in England & Wales with company registration number 51491) with registered office at 1 City Place, Gatwick, England, RH6 0PA and VAT registration number is GB 169562721.

ii) For orders place on the ROI Website the trading address is Nestlé (Ireland) Ltd with registered office at 3030 Lake Drive, Citywest Business Campus, Dublin D24 KX6Y and VAT registration number is IE8Z45096M

iii) By registering or placing an order with us online you agree to be bound by these terms and conditions ("Conditions") which shall apply to all items advertised on our UK Website at www.dolce-gusto.co.uk or ROI Website www.dolce-gusto.ie. (the "Website"). Please read these Conditions carefully. You should print a copy of these Conditions for future reference. If you do not accept them, you will not be able to order item/s from the Website.

iv) By placing an order through the Website you warrant and represent that you are legally capable of entering into binding agreements and you are at least 18 years old.

v) An order placed by you is an offer and is only binding on us when we accept it. We will confirm such acceptance (if any) by sending you an email that we have received confirmation of your order, at which point a contract between us will be formed.

vi) Bulk orders from the trade or consumer groups will not be accepted.

vii) Title in the item/s shall remain with us until we have received cleared payment. The risk in the item is passed over when the goods are successfully delivered.

viii) The Website sells various products as may be listed from time to time.

ix) There is a maximum order value of £200 per transaction for the UK Website and €250 per transaction for the ROI Website. Orders attempted over this value will not be processed or charged.

x) There is a minimum order requirement on the UK Website of 4 boxes of pods, or £20. This applies to all delivery options.

xi) There is a minimum order requirement on the ROI Website of 4 boxes of pods, or €25. 

 

2) PRICE

i) The items indicated as for sale in the UK Website are available for sale at the sterling prices indicated on the UK Website. These prices include VAT.

ii) As detailed further below, if Standard delivery is chosen, there is no additional cost on top of the sterling prices of the products indicated on the UK Website. If Next Day delivery is chosen, there will be a charge of £4.99 on top of the sterling prices of the products indicated on the UK Website.

iii) On the ROI Website, the items indicated for sale are available for sale at the Euro prices indicated on the ROI Website. These prices include VAT.

 

3) METHOD OF PAYMENT

i) Payments may be made by the following credit and debit cards: Visa and Mastercard. We will not dispatch your order until we have received cleared funds from your account.

ii) We reserve the right to terminate our agreement with you if we are refused authority for payment or reasonably believe that payment will be refused at any stage.

 

4) DELIVERY

i) Delivery will be made to the address specified by you when you register on the Website, provided the address is within the UK or Republic of Ireland

ii) You have the ability to change this address through the "My Account”, “My Addresses” " feature and during the confirmation stage at the checkout. It is your responsibility to ensure you are available to receive the delivery. You will be notified by a Delivery Confirmation email that your order is on its way.

iii) If you are not at home when the courier delivers your parcel, they will endeavour to leave it in a safe location within your property or with a neighbour. To protect the safety of your goods we have certain guidelines in place as to what counts as a 'safe location'. For example, in or around waste bins is not permitted.  If this happens, the courier will post a card through your door to let you know where the parcel has been left. Alternatively, they will attempt to deliver at a later date. If this happens they will leave a card with a parcel reference number on it. With this number you can find out where your parcel is and re-arrange a delivery over the phone or through the couriers online tracking system. After three attempts the goods will be returned to us and you will be refunded the full value of the purchase, minus the delivery charge. From that point, if you still wish to receive your order, you will have to re-order via the online shop.

iv)  Products are subject to availability and prevailing market conditions. In the event of non-availability of any goods, this will be stated on the Website. From time to time delivery times may be impacted by external conditions beyond our control.

v) On the UK Website, the following delivery options are available. Where an order is accepted, we will use reasonable endeavours to ensure that item/s is/are delivered within the time frame below:

FREE Standard Delivery (UK Website) - Free of charge
- Orders will be delivered in 3-5 working days from day order placed
- For orders to the Scottish Highlands and Islands, Scilly Isles, IOM and Channel Islands, deliveries will take up to approximately 8 working days.
- Orders placed at the weekend or after 5:30pm will be processed on the next working day.
- Orders over the seasonal period may take longer.

NEXT DAY Delivery (UK Website) -  Delivery charge £4.99
- Express day delivery option is available on orders placed before 5:30pm Sunday to Friday inclusive, excluding bank holidays. 

- Orders placed for next day delivery before 5:30pm on a Saturday will not be delivered until the next working day.
- Please note we do not deliver on bank / public holidays.

- Please note if you select this service it will require a signature on delivery.

- Please note this is a 2 day delivery service to Northern Ireland.

- Please note this service is not available in the Scottish Highlands and Islands, Scilly Isles, IOM, Channel Islands and Isle of Wight.

vi) On the ROI Website, for any orders over the value of €25 or containing 4 boxes of pods, the delivery will be free of charge.

vii) On the ROI Website, where an order is accepted, we will use reasonable endeavours to ensure that item/s is/are delivered within 5 working days of placing the order subject to availability of stock and receipt of clear funds.

viii) Please note that for the UK and ROI Websites the minimum order provisions stated in section 1) apply to all delivery options.

ix) If you do not receive your order within 5 working days of receiving your delivery confirmation email, please notify us in writing or by phoning our Consumer Services team on 0800 707 6066 in the UK or 00800 6378 5385 in ROI.

 

5) DEFECTIVE GOODS OR INCOMPLETE OR INCORRECT ORDERS

i) You must inspect the goods and notify us within 14 days of delivery in writing to Nestle UK Ltd, PO Box 207, York YO91 1XY, UK or by phoning our Consumer Services team on 0800 707 6066 in the UK or 00800 6378 5385 in ROI, if for any reason you are unsatisfied. If the item you purchase is faulty we may offer a repair, exchange or refund as appropriate in accordance with your legal rights.

 

6) AMENDMENT OF ORDERS & CANCELLATION RIGHTS

i) You may cancel your order at any time from the date of the order up until the date that is 14 working days from receipt of the item/s by filling out the withdrawal form below or by calling our Consumer Services team on 0800 707 6066 in the UK or 00800 6378 5385 in ROI. If you cancel your order before you have received the item/s, you are entitled to refuse to accept delivery of the item/s and we will send a cheque or refund to your account with a full refund within 14 days of your refusal to accept delivery of the item/s. If you cancel your order of the item/s after you have received it/them you must return the item/s to us in an undamaged and unused condition at your expense within 14 days from informing us of your cancellation.  Within 14 days of receipt of your item/s, we will send a cheque or refund to your account with a full refund including delivery costs.  This provision does not affect your statutory rights.

7) LIABILITY

i) Save in respect of death or personal injury caused by our negligence, to the extent permitted under law, our liability shall be limited to the purchase price of the item in question.

ii) The images of the items on our site are for illustrative purposes only. Although we have made every effort to display the colours accurately, we cannot guarantee that your computer's display of the colours accurately reflect the colour of the items. Your items may vary slightly from those images

 

8) PRIVACY

i) At the time of your registration you will receive a password. Please keep this secret, as you are entirely responsible if you do not maintain the confidentiality of your password. You are entirely responsible for all orders placed with us or information given to us under your e-mail address in combination with your password. You agree to store your account details securely, to log off after placing any order and not to share your account details with anyone else (unless you want them to place an order on your behalf). You must immediately notify us of any unauthorised use of your e-mail address and/or password or any breach of security known to you.

9) MY NESCAFE DOLCE GUSTO

i) On the UK Website, “MY DOLCE GUSTO” membership is open to UK residents aged 18 and over, with the exception of employees of Nestlé UK Ltd and Nestle Ireland, their families, agents or anyone professionally associated with the administration of this promotion.

ii) On the ROI Website, “MY DOLCE GUSTO” membership is open to ROI residents aged 18 and over, with the exception of employees of Nestlé Ireland and Nestle UK Ltd, their families, agents or anyone professionally associated with the administration of this promotion.

iii) An individual must have a unique, valid email address to create an online My DOLCE GUSTO membership account. Limited to one account per person.

iv) The Promoter reserves the right to alter, amend, suspend or terminate My DOLCE GUSTO, in whole or in part, at any time giving one month's notice in writing.

v) The Promoter reserves the right to refuse any application and to terminate the account of anyone that is believed to be in breach of the offer Conditions.

vi) Any attempt to deliberately damage the Website or the information on it, or to otherwise undermine the legitimate operation of any promotion may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law.

vii) Attempting to gain access to someone else's account and/or account information, or trying to obtain, generate, or guess another users account information is strictly forbidden and should any participant attempt to do this, their account will be deleted and they will be permanently banned from the Website. The Promoter may decide to take further action.

viii) A decision of the Promoter in all matters is final and binding. The Promoter, Nestlé UK Ltd, shall not be liable or responsible for any loss, damage or liability caused by matters relating to this promotion.

Lines are open Monday to Friday from 9am – 5pm.

x) From time to time, limited edition promotions will be offered to “MY DOLCE GUSTO” members. Details of the latest promotions and offers can be found in Sections 10 & 12 below. 

 

10) SUBSCRIPTION SCHEME

N.B. THIS SCHEME IS CURRENTLY AT ITS MAXIMUM MEMBERSHIP LEVEL. AN ANNOUNCEMENT WILL BE MADE ON THE WEBPAGE IF/WHEN WE BECOME OPEN FOR NEW REGISTRATIONS.

i)    When you register for the NESCAFÉ® Dolce Gusto® Subscription scheme (the Scheme) on our web site you will automatically be signed up to receive a delivery of pods;

ii)   Pods will be dispatched to you once a month on the date you signed up for the Scheme. We promise that we will not increase our prices for 6 months from the start of the Scheme which is 24th August 2015;

iii)  If the prices increase you will be notified by email before your next order is placed;

iv)  We can only accept three [3] subscriptions for the Scheme per household (businesses are not eligible for participation in this Scheme);

v)   You can make changes to your orders or subscription at any time. Please sign into “My Account” for details. You will be notified by email that your account has been changed / cancelled. Any orders that have been processed before the change/cancellation will be dispatched by us;

vi)   If you choose to order between 4 and 5 pod boxes of your choice per month, your second order and every order thereafter will be eligible to a 5% discount;

vii)  If you choose to order between 6 and 9 pod boxes of your choice per month, your second order and every order thereafter will be eligible to a 10% discount;

viii) The maximum number of pod boxes per delivery is 9;

ix)   If you subscribe for 6 or more pod boxes per delivery and receive 12 months’ of deliveries during a continuous 15 month period then you will be eligible for a free NESCAFÉ® Dolce Gusto® machine (free machines do not include the Movenza or Eclipse models). This free machine offer will be valid for the first year only and is restricted to one free machine per household. Model availability will depend on the travailing stock situation at the time of redeeming the offer. In the event of low stocks of any particular model, available machines will be offered on a first-come, first-served basis;

x)    If a NESCAFÉ® Dolce Gusto® product is out of stock, we will notify you via email and ask you to make an alternative choice before your order is processed;

xi)   If a product within your subscription has been discontinued we will notify you via email and ask you to make an alternative choice before your order is processed;

xii)  Subscription offers cannot be used in conjunction with any other offers. In the event of a Subscriber wishing to take up any of the non-subscription promotional offers available from time to time, they will be required to place a separate non-subscription order to qualify for that offer;

xiii) Magnum Packs are not available for inclusion in any order made via the Subscription Scheme;

xiv) From time to time, Limited Edition packs may be offered for sale via the NESCAFÉ® Dolce Gusto® webshop.  These Limited Editions will not be available as part of the Subscription Scheme but can be purchased separately;

xv)  The Promoter reserves the right to terminate the NESCAFÉ® Dolce Gusto® Subscription Scheme at any time by a) making an announcement on the website and b) directly contacting all existing active members giving them one month’s notice via an email to the email address on their original registration. In such an event existing members will be given 28 days to redeem any remaining eligible rewards that have not yet been claimed.

 

11) GENERAL

i) Applicable laws require that certain communications should be in writing. You agree that we may communicate with you by email, by posting notices on the Website or by writing to you at your postal address and accept (without affecting your statutory rights) that such communications comply with any legal requirements for any communications to be in writing.

ii) Our agreement shall be governed by English law and the parties submit to the exclusive jurisdiction of the English courts.

iii) We have the right to amend these Conditions from time to time. You will be subject to the terms and conditions in force at the time that you place on order, unless any change to such terms and conditions is required by law or government authority.

iv) All notices given by you must be sent by post to our address NESCAFÉ® DOLCE GUSTO® Returns Services, PO BOX 207, York YO91 1XY.

v) Notices will be deemed received and properly served within 5 days of receipt by us. Notices may be posted in the Website, sent via email or through the post.

12) ON PACK, SOCIAL MEDIA AND OTHER SPECIAL OFFERS, PROMOTIONS & COMPETITIONS

12.1 WIN 10 BOXES OF COFFEE WITH NESCAFÉ® DOLCE GUSTO®

These terms and conditions (the “Terms and Conditions”) prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. Entry instructions are deemed to form part of these Terms and Conditions and by participating all participants will be deemed to have accepted and be bound by them. Please retain a copy for your information.

The Promoter takes data protection seriously. By entering this promotion, you confirm that you have read the Privacy Policy for the applicable platform, and agree to these Terms and Conditions of the promotion. By submitting any information required as part of their participation into the campaign, participants agree to their information being held and processed in accordance with the General Data Protection Regulation (GDPR).

Eligibility to enter

1. This Promotion is open to UK (England, Scotland, Wales and Northern Ireland) residents ONLY. Employees and the immediate families of the Promoter, its agencies, affiliates or anyone professionally connected to the Promotion are not eligible to enter.

2.   Entrants must be aged 18 or over. Internet access required. Registration/Log in required on www.dolce-gusto.co.uk

3.  Purchase required. To take part in the promotion simply enter a unique code that can be found in any boxes of NESCAFÉ Dolce Gusto pods or boxes of Starbucks by Nescafé Dolce Gusto. Participants will require a new unique code for each draw entry.

4.  No person may win more than one prize throughout the promotion.

5. To enter without purchase in Northern Ireland only, participants must send their name, date of birth, email and full postal address to: NESCAFÉ Dolce Gusto Win 10 Free boxes of Pods Promotion, NPN, Consumer Services, Nestlé UK Ltd, Haxby Road, York YO91 1XY”. Only one promotional code will be issued per stamped, mailed envelope.  Bulk entries or entries sent through trade, consumer groups, agents or third parties will not be accepted.  Once the request has been verified, a promotional code will be provided via email to the email address provided, which can then be entered on NESCAFÉ Dolce Gusto website to enter the promotion. Maximum of one (1) ‘No Purchase Necessary’ entry per person throughout the promotion.

Requests for a free code must be received by no later than 19th March 2020.

Codes

6. Codes can be found in any boxes of pods from NESCAFÉ Dolce Gusto or in Starbucks by Nescafé Dolce Gusto boxes.

7. Codes are case sensitive and must be entered online exactly as they appear in the pack.  Each code is unique and can only be used once.  Attempts to enter the same code more than once, the use of codes from non-promotional packs, or the use of any promotional codes not intended for use in this Promotion, may result in disqualification and all entries will be declared void.

8. The codes have no value and cannot be transferred or sold.

9. The Promoter does not assume any responsibility for codes damaged or defaced in the way the product packaging is opened.  Participants, who cannot read their code due to a genuine printing error, should send the packaging along with their name, email address and postal address to the Promoter at, NESCAFÉ Dolce Gusto Win 10 Free boxes of Pods Promotion, NPN, Consumer Services, Nestlé UK Ltd, Haxby Road, York YO91 1XY, and, if genuine, a replacement code will be sent to them.  Please allow up to seven (7) working days for this process to occur.

Promotional Period

10. Promotion open for entries on 25th September 2018 and closes on 31st March 2020.

11. There are nineteen (19) draws in total. Valid Entries from each month go into the relevant draw for that month. The promotional period for entry into each relevant draw is as follows:

MONTHLY DRAWS:

DRAW 1: Entries from 12:00 on the 25th September 2018 until midnight on the 30th September 2018

Then monthly

DRAW 2: Entries from 00:01 on the 1st October 2018 until midnight on the 31st October 2018

DRAW 3: Entries from 00:01 on the 1st November 2018 until midnight on the 30th November 2018

DRAW 4: Entries from 00:01 on the 1st December 2018 until midnight on the 31st December 2018

DRAW 5: Entries from 00:01 on the 1st January 2019 until midnight on the 31st January 2019

DRAW 9: Entries from 00:01 on the 1st May 2019 until midnight on the 31st May 2019

DRAW 10: Entries from 00:01 on the 1st June 2019 until midnight on the 30th June 2019

DRAW 11: Entries from 00:01 on the 1st July 2019 until midnight on the 31st July 2019

DRAW 12: Entries from 00:01 on the 1st August 2019 until midnight on the 31st August 2019

DRAW 13: Entries from 00:01 on the 1st September 2019 until midnight on the 30th September 2019

DRAW 14: Entries from 00:01 on the 1st October 2019 until midnight on the 31st October 2019

DRAW 15: Entries from 00:01 on the 1st November 2019 until midnight on the 30th November 2019

DRAW 16: Entries from 00:01 on the 1st December 2019 until midnight on the 31st December 2019

DRAW 17: Entries from 00:01 on the 1st January 2020 until midnight on the 31st January 2020

DRAW 18: Entries from 00:01 on the 1st February 2020 until midnight on the 29th February 2020

DRAW 19: Entries from 00:01 on the 1st March 2020 until midnight on the 31st March 2020

12. All valid entries received during the promotional periods will be entered into the relevant draw, which will take place three (3) working days after the closing date of each draw.

How to enter

13. The Promotion is available for any packs of NESCAFÉ Dolce Gusto pods or Starbucks by Nescafé Dolce Gusto packs, bought during the promotional period. 

14.To enter the monthly draw;

  1. Find the 12-digit unique code printed inside any NESCAFÉ Dolce Gusto packs or Starbucks by Nescafé Dolce Gusto packs.
  2. Log in/Register on www.dolcegusto.co.uk/win
  3. Enter the code as instructed.

15. Entrants may enter as many times as they wish provided they use a new unique code from a new NESCAFÉ pods pack for each further entry into the draw. No one person may win more than one prize throughout the promotion.

Selecting the winners  

17. Ten (10) winners will be drawn at random from each of the 19 monthly draws, giving  19 x 10 (190) winners in total. Each winner will win 10 boxes worth of free coffee in the form of £45 worth of webshop vouchers, including free standard delivery, to use on www.dolce-gusto.co.uk website. The number of pods will depend on variety of coffee chosen.

18. Each £45 webshop voucher can only be used in its entirety for items up to a maximum value of £45, or as part payment for goods purchased online with a value of over £45. No credit or change given if less than £45 is spent in a single transaction when the voucher is used.

19. All winners will be selected at random via an independently supervised draw from all eligible entries received for the relevant draw. No one person may win more than one Coffee prize throughout the duration of the promotion.

20.  When registering for the Promotion, entrants will be required to provide information including their first name, last name, email address and must confirm they are above 18 years old. Participants must enter their home address and phone details under “My account” section on www.dolce-gusto.co.uk in “My address”, postal address, phone number and email address.  In the event that the specified information is not provided, the entry will be considered incomplete and therefore invalid. 

21. Registered contact details will only be used to notify winners of their prize and verify the relevant account details to confirm the account to which the vouchers will be allocated to.   Therefore, all entrants must ensure they provide valid contact details and are contactable for the duration of the Promotion.  In the event of an entrants’ email address becoming inaccessible during the Promotion, the Promoter is not able to retrieve and amend any existing entries to a new email address.

22.  Each draw will take place and the winners will be notified by email within seven (7) working days of each draw closing date.

24.  The Promoter reserves the right to withdraw prizes if any of the prize winners cannot be contacted within 28 days and after three attempts.

The Prizes

25.  The prizes available for each draw are as follows:

£45 worth of vouchers to use on www.dolce-gusto.co.uk website.

Each £45 win will be covered off in the form of a voucher which will cover the free order of 10 boxes of any 16-pod boxes (8 pod boxes on certain products where milk included) including free standard delivery.

All vouchers will be valid for 12 months from receipt.

Vouchers cannot be used for Subscription orders.

Vouchers must be used in a single transaction. No change, credit balance or cashback will be available.

Vouchers cannot be transferred to another registered member.

Only 1 voucher can be used per order.

Voucher cannot be used in conjunction with another promotional voucher.

Notification and delivery of prizes

26. Each relevant draw winners will receive an email message with details of a secure URL where they can provide information for prize verification and to start the claim process.

27. Winners will have 28 days from the date they have received their winning email message to respond and provide their details to ensure verification of their claim, otherwise they will be lose their prize eligibility and the prize may be forfeited. The Promoter reserves the right to award the prize to a reserve winner who is next in line from the original relevant draw. Winners should retain their notification email message until their win has been verified.

28. It is the responsibility of the winners to provide their correct, up-to-date details at the time of acceptance for their prize to be processed. The Promoter, the administrator, nor its fulfilment agent can be held responsible for the winners failing to supply accurate information which affects Prize acceptance.

29. Once verification has occurred - the relevant prize voucher(s) to use on www.dolce-gusto.co.uk website will be sent via email to the winners within two (2) working days of prize acceptance.

General

30. The Promoter reserves the right to verify all entries and the winners and to refuse to award a prize or withdraw prize entitlement and/or refuse further participation in the promotion and disqualify the participant where there are reasonable grounds to believe there has been a breach of these terms and conditions or any instructions forming part of this promotion’s entry requirements or otherwise where a participant has gained unfair advantage in participating in the promotion or won using fraudulent means; or to be acting in any manner deemed by the Promoter to be disruptive.

31. All potential winners are subject to verification of eligibility and compliance with these Terms and Conditions and the Promoter reserves the right to verify all winners.

32. Proof of sending is not proof of receipt.  Responsibility cannot be accepted for claims that are lost, damaged or delayed, nor any associated costs to entrants/participants.

33. There are no cash or other alternatives available, in whole or in part, except that in the event of circumstances outside of its control, the Promoter reserves the right to substitute similar alternatives of equal or greater value.

34. Prizes are as specified and are non-transferable.  

35. Limitations of liability:  Neither the Promoter, its agents or anyone professionally connected to the Promotion, assume any responsibility or liability for:

a. Any incorrect or inaccurate code entry, or for any faulty or failed electronic data transmissions.

b. Any unauthorised access to, or theft, destruction or alteration of codes at any point in the operation of this Promotion.  Communications line failure, regardless of cause, with regards to any equipment, systems, networks, lines, satellites, servers, computers or providers utilised in any aspect of this Promotion.

  4. To enter the Promotion, entrants will be required to register and create an account if they do not already own one. If entrants already own an account, they will need to login. Selecting the Winners

Notification of Winners and Delivery of Prizes

  1. The winners will be notified via the email used to submit their review within 7 working days of the promotion closing date (13.09.19).

  3. 18. When registering for the Promotion, entrants will be required to provide information including their first name, last name, a genuine email address and must confirm they are above 18 years old. Participants must enter their home address and phone details under “My account” section on www.dolce-gusto.co.uk in “My address”.  In the event that the specified information is not provided, the entry will be considered incomplete and therefore invalid.

19. Registered contact details will only be used to notify winners of their prize and verify the postal address to which the winner’s prize will be sent. Therefore, all entrants must ensure they provide valid contact details and are contactable for the duration of the promotion. In the event that the specified information is not provided, is an alias, or is incorrect, the entry will be considered incomplete and therefore invalid.

20. In the event of an entrants’ email address becoming inaccessible during the promotion, the Promoter is not able to retrieve and amend any existing entries to a new email address.

In addition to the “Win Breakfast on a Private Island” promotion, when participants enter a code from a pack of NESCAFÉ Dolce Gusto their code will also automatically be entered into an additional monthly “Win 10 Free Boxes of Pods” draw. 10 winners each month. The Prizes

Major ‘Great Breakfast Experience’ Prizes (Tier 1)

21. There are three (3) major prizes of ‘Great Breakfast Experiences’ (worth up to £9,300 each) to be won in total during the main promotional period. Winners of the major prizes will be drawn at the end of the main promotional period from all entries into the weekly prize draws. Further information for prizes are as follows:

  • 7 nights package holiday for two adults to Anantara Kihavah Resort Maldives.
  • Travel is valid until February 2021, excluding Christmas (15th December – 2nd January 2020), Easter (Friday 10th April – Monday 13th April 2020) and all UK Bank Holidays (8th – 10th May 2020, 23rd – 25th May 2020, 29th – 31st August 2020). Both members of the party must be aged 18 or over, except where the winner is the parent or legal guardian of the accompanying minor.
  • Prizes are based on two people sharing one private room.

22. The entrant will receive no fees in relation to their entry into this Promotion. All costs incurred by obtaining time off from work or study to take part in the Promotion are the responsibility of the Winner. The Promoter accepts no responsibility for costs incurred.

23. The prize must be accepted as awarded and may not be refunded if unused. No cash or other alternatives are available in whole or in part, except in the event of circumstances outside of its control, the Promoter thereby reserves the right to substitute similar alternatives of equal or greater value. Unless otherwise agreed with the Promoter, a winner is not permitted to transfer the right to take up a prize to anyone else. No substitutions, changes or extensions to the prize are permitted.

25. This promotion is in no way sponsored, endorsed or administered by, or associated with the manufacturers of these promotional items (Wake-up Light Alarm Clock with Sunrise Stimulation and Smart Speakers). Entrants to this promotion hereby release the manufacturers from any claim or liability suffered in connection with this promotion.

 

Winner Selection and Notification

26. A total of three (3) winners will be drawn at random from all genuine, valid entries made throughout the main promotional period for the major draw, giving three (3) major ‘Great Breakfast Experience’ (tier 1) winners in total. The three major prize winners will be drawn within five (5) working days of the final closing date of the main promotional period. (12.01.20).

27. A total 157 winners will be drawn at random for each of the 13 weekly draws, as specified above, giving 13 x 157 (2041) weekly (tier 2) winners in total. All winners will be selected at random via an independently supervised draw from all eligible entries received for that draw the following working day after the relevant weekly closing date.

28. For the late entry draw, 157 winners will be drawn at random from all valid entries received between 13.01.20 and 28.02.20 to win 1 of 157 additional (tier 2) prizes. Late entry draw winners will be selected within five (5) working days of the late entry draw closing period.

29. No one household may win more than one prize in any tier throughout the duration of the promotion.

30. Winners will be notified by email of their win within seven (7) working days of each relevant draw taking place, providing further details and claim instructions.

31. The Promoter will make reasonable efforts to contact the winners, however, if a winner has not responded to notification within 28 days, or if a selected winner is ineligible, otherwise in breach of these Terms and Conditions, or unable to take up the prize for any other reason, the Promoter reserves the right to select the reserve next in line from the original draw. Only one reserve winner will be selected for each of the prizes. Any unclaimed prizes from any of the draws will be forfeited and declared null and void.

 

Prize Claim/Fulfilment Instructions

Major ‘Great Breakfast Experiences’ Prizes (tier 1)

32. Winners of the major ‘great breakfast experience’ prizes (3 x winners), when contacted, will be provided with a secure URL where they can provide the Promoter with information including identification and proof of address, for prize verification purposes.

33. Great Breakfast Experience bookings must be made through the fulfilment agency Golden Goose Travel Ltd. ATOL Number 10475.

34. A dedicated member of the Promoter’s travel partner will manage the booking from start to finish and expert assistance and advice will be provided for any additional excursions / tours the winner wishes to book at their own expense. The winner and their guests will be provided with a 24 hour emergency helpline by the fulfilment agency/travel partner.

35. Travel dates are subject to availability. Travel will be subject to flight and hotel availability at the date of booking the trip. The prize winner must notify the fulfilment agency at least six weeks in advance of his/her preferred dates for taking the flights.

36. All Winners must complete their travel by 28.02.21. Extensions to the validity of the prize will not be allowed unless first authorised by the Promoter.

37. Neither the Promoter or its fulfilment agency accept any responsibility for any elements within the prize or booked through the fulfilment agency at the winner’s expense being withdrawn or amended. In the event of this, the fulfilment agency will endeavour to offer a suitable alternative.

38. All travel arrangements offered are at the discretion of the Promoter and fulfilment agency

39. Any amendments wished to be made by the prize winner after the booking is confirmed are subject to the discretion of the Promoter and may be subject to administration charges levied by the specific supplier.

40. The prize winner and their party (where applicable) are responsible for and must comply with any health advice/regulations/inoculations required by any destination country. Any associated costs for this are the responsibility of the prize winner and their party (where applicable).

41. The Winner and their guest must not have any limitations upon their ability or rights to travel to and from both the experience/prize destination and the departing country. The right to refuse entry to either country is held by Passport control and countries authorities. The Promoter and Prize Partners accept no responsibility for ensuring the Winner or their guest are able to travel and are not responsible for any costs incurred should entry be refused by Passport control or the countries authorities.

42. The prize winners and their travelling guests are responsible for: any and all costs, expenses and taxes not expressly described herein including, without limitation, ground transportation, gratuities, merchandise, telephone calls, personal expenses of any nature for overnight layover, meals and beverages, service charges and entertainment; costs incurred to and from the departure point as the Prize originates and terminates there.

43. Prize winners will be responsible for any other incidentals on the trip and in the hotel and will be required to give credit card details on check in.

44. Health insurance is provided by the fulfilment agency for winners up to the age of 79 with no pre-existing medical conditions.

45. All health insurance policies are dealt with on a case by case basis and vary depending on the age of the winner and their guest.

46. Winners and guests take full responsibility for any risks associated with traveling to, in and from the prize destination and departing country. The Promoter will (with the Winners and guests) take into account any travel advice from the UK Government to ascertain whether there are any issues with potential travel and will try and assist with suitable alternatives should there be major concerns. The Promoter or The Prize Partner can provide advice and recommendations, however they are not responsible for any loss or damage suffered by the Winners and/or travellers in relation to this promotion, the exercise of the prize.

47. All potential winners are subject to verification of eligibility and compliance with these Terms and Conditions and may be disqualified if found to be in breach.

48. Only valid information will be accepted. Entry information may not be sold or exchanged. Other manufacturer’s information, reference or printing errors do not constitute entry information.

49. The prize winner’s guest(s) must be over the age of 18 years, except where the winner is the parent or legal guardian of the accompanying guest.

50. The Prize winner and their guest must all be in possession of a full, current and valid passport and will be solely responsible for attaining any required visas, vaccinations or travel permits. Passports and all necessary visas are the prize-winners’ responsibility. Passports must have a minimum of 6 months’ validity remaining from the return date.

Weekly and late entry draw Prizes (Tier 2)

51. Winners of the weekly and late entry draw prizes, when contacted, will be provided with a secure URL where they can provide information for prize verification and prize delivery. Prizes will be delivered via Royal Mail or Courier within 28 days of winning to the address confirmed via the secure URL.

52. ThePromoter accepts no responsibility for failed delivery due to provision of incorrect contact details by winners. Failure to provide a valid postal address may result in the prize being forfeited and the prize entitlement withdrawn. Any prize that is returned undelivered with be assumed unwanted and shall be forfeited.

 

General

53. The Promoter reserves the right to verify all entries and the winners, including, but not limited to, asking for the receipt and relevant code from the participating pack, email address and identity details including address (which they must provide within 28 days), and to refuse to award a prize or withdraw prize entitlement and/or refuse further participation in the promotion and disqualify the participant where there are reasonable grounds to believe there has been a breach of these Terms and Conditions or any instructions forming part of this promotion’s entry requirements or otherwise where a participant has gained unfair advantage in participating in the promotion or won using fraudulent means; or to be acting in any manner deemed by the Promoter to be disruptive.

54. Entries made from additional email accounts will not be accepted. If it becomes apparent that an entrant (person) is using an alternate or alias email account(s) in addition to their own as a means to circumvent this condition that person’s entries will be subsequently disqualified and any prize awarded, or in the process of being awarded, will be void.

55. Proof of sending is not proof of receipt.  Responsibility cannot be accepted for claims that are lost or delayed, nor any associated costs to entrants/participants. Winners may be asked to provide their promotional pack as proof of purchase in order to verify their claim.

56. There are no cash or other alternatives available, in whole or in part, except that in the event of circumstances outside of its control, the Promoter reserves the right to substitute similar alternatives of equal or greater value

57. Prizes are as specified and are non-transferable. 

58. Limitations of liability:  Neither the Promoter, its agents or anyone professionally connected to the Promotion, assume any responsibility or liability for:

 a) Any incorrect or inaccurate code entry, or for any faulty or failed electronic data transmissions.

 b) Any unauthorised access to, or theft, destruction or alteration of codes at any point in the operation of this Promotion.  Communications line failure, regardless of cause, with regards to any equipment, systems, networks, lines, satellites, servers, computers or providers utilised in any aspect of this Promotion.

 c) Inaccessibility or unavailability of the internet or the website or any combination thereof.

 d) As far as permitted by law, any damage, loss, liabilities, injury, costs, expenses or claim (whether in contract, tort or otherwise) suffered by entrants or any third parties arising out of or in connection with the Promoter and/or accepting a prize.

59. In the event of circumstances outside the Promoter’s reasonable control and only where circumstances make this unavoidable, the Promoter and those partnered with the promotion reserve the right to cancel or amend the promotion or these Terms and Conditions at any stage but will endeavour to minimize the effect to entrants in order to avoid undue disappointment.

60. The Promoter’s decision is final and binding in all matters.

61. By taking part in the promotion, major ‘great breakfast experience’ prize winners (tier 1) agree that Nestlé may contact them to ask whether they want to participate in marketing activities relating to the promotion.

62. Winners List: Subject to the Promoter’s Privacy Policy which can be found at https://www.dolce-gusto.co.uk/policy-privacy/, the surnames and counties of all verified major prize (tier 1) winners will be available upon request by sending an email to dolce-gusto@UK.nestle.com with the subject line ‘WINNERS LIST: NDG WIN BREAKFAST PROMOTION’ for a period of 3 months following the end of the promotion. If any winner objects to their information being published, then they can contact the Promoter by emailing: UKI.Dataprotection@uk.nestle.com.

63. If any of these clauses should be determined to be illegal, invalid or otherwise unenforceable then it shall be severed and deleted from these Terms and Conditions and the remaining clauses shall survive and remain in full force and effect.

64. The Promotion and these Terms and Conditions will be governed by the laws of England. The courts of England and Wales will have exclusive jurisdiction over any and all disputes arising out of, relating to, or concerning these Terms and Conditions.

65. Data Protection: The Promoter will only use the personal details supplied for the administration of the promotion and the auditing of the entries where necessary and for no other purpose, unless we have your consent and you have opted-in to receive future marketing communications. As part of this promotion, if you are not opted-in into our general marketing email, you will still receive emails for this promotion only to let you know if you have won.
